Travelpigg users are subject to the following Terms of Use when using the Travelpigg website. These may be updated regularly by Travelpigg without notice to you. These terms and conditions govern your access to, and use of the Travelpigg website, located at www.travelpigg.com. Travelpigg is owned and operated by Travelpigg Pty Ltd.

Effective Date of the Travelpigg Terms of Use Agreement

This Terms of Use Agreement by Travelpigg is effective as of February 14, 2010 and last updated February 14, 2010.

Travelpigg User Agreement

By browsing, accessing or clicking the "I ACCEPT" and/or "SUBMIT" button (upon registration), you are agreeing to the terms and conditions and any of the guidelines stipulated. Your use of the Site subsequently indicates your acceptance to these terms, as they exist at the time.
If you do not agree to the terms and conditions of this Site, please do not access or continue to use this Site, "travelpigg".

Changes To This User Agreement

The terms and conditions of this Site are subject to change at Travelpigg's sole discretion. Travelpigg will inform users of any alterations to this agreement by posting a new version on the Site and update the effective date set forth above.
Your continued use of the Site post notification will indicate your acceptance to these changes and further to the terms and conditions of this Site.

Your Registration

To access certain areas and services of the website, you must register with Travelpigg. When registering you are required to provide travelpigg with accurate, complete and current registration information. It is your responsibility to inform Travelpigg of any updates to your information. You must not impersonate or create a membership for any person other than yourself.

You must ensure the security and confidentiality of your membership details, including any username and/or password assigned to you. You are wholly responsible for all activities that occur under your membership details.
If you become aware of any unauthorized use of your account please notify travelpigg immediately.

Failure you to comply with these terms may result in suspension or termination of your account.

Termination

If you breach any of the terms or conditions of use, Travelpigg reserves the right to terminate or suspend your Travelpigg account without prior notice or liability. Your right to use the services of the Site will terminate instantly.
If you wish to terminate your Travelpigg account, you may simply discontinue using the Services.

Your Conduct

This Conduct Policy governs your conduct whilst using this Site (travelpigg.com) and the services on this website.
Any violation of this policy may result in the suspension or termination of your account or use of our service.
As a condition of use, you agree to the following list which describes the kinds of illegal or harmful conduct that are prohibited on our Site. You agree not to create, submit or otherwise transmit any user content that:

(a) Is not relevant to the subject matter of the article, commentary, product, service, person or entity;
(b) Is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, known to be false and presented as truth, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
(c) You do not have a right to transmit under any law or under contractual or fiduciary relationships (such as, but not limited to, inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure Codes)
(d) Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(e) Potentially infringes any patent, trademark, trade secret, copyright or other proprietary rights of any person or entity; or
(f) Unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.

You agree not to use the services:

(a) For any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
(b) With the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;
(c) With the intention of artificially inflating or altering the 'Travelpigg Vote Count', comments, or any other Travelpigg service, including by way of creating separate user accounts for the purpose of artificially altering Travelpigg's services; giving or receiving money or other remuneration in exchange for votes; or participating in any other organized effort that in any way artificially alters the results of Travelpigg's services;
(d) To attempt to impersonate another user or person; sell or otherwise transfer your profile.

Liability & Indemnity

Travelpigg does not warrant the accuracy of the content on the Site. The content is provided to you "as is" and on an "as available" basis and on the condition that you undertake all responsibility for assessing the accuracy of the content and rely on it at your own risk. All content on the Site may be withdrawn at Travelpigg's sole discretion and without notice.

Travelpigg does not warrant that functions contained in the Site content, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected or that Travelpigg or the server that makes it available, are free of viruses or bugs.

You can access other sites via links from Travelpigg. These sites are not under our control and we are in no way responsible in any way for their contents. Travelpigg is not responsible nor no duty to take any action regarding: the content and what effect it may have on you or how you may interpret or use this content. Travelpigg is also not responsible for any actions you make take as a result of being exposed to the content provided by Travelpigg or links via Travelpigg.com.

You acknowledge that Travelpigg has no control over, and no duty to take any action regarding: which users gain access to the Site or use the Services; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content.

Travelpigg may contain or direct you to external sites that may contain information that you find offensive. Travelpigg does not take responsibility for this content, nor is responsible or liable for the accuracy, copyright compliance and legality of this material.

Travelpigg will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your use of or access to this Site.

Travelpigg To the extent permitted by law, all other representations, conditions or warranties, whether based in statute, common law or otherwise are excluded. Liability of Travelpigg for any breach of a term or condition implied by law is limited at Travelpigg's discretion, to the supply of any service again or the payment for the cost of having any service supplied again.
You indemnify Travelpigg and its affiliated companies, and each of their directors, officers, employees and agents against any action, claim, loss or expense, which it incurs, which arises from your use of the Site.

You are solely responsible for your activities on our Site. This includes all User Content that you submit or a third party submits on your behalf using your credentials and account.

You agree to be held liable by Travelpigg and its, directors, shareholders officers, employees and assigns against any and all third party claims, actions, demands, suits and all related losses, liabilities, damages, penalties, costs and expenses (including, but not limited to, attorney fees) incurred by a liable party related to or arising from:

(a) Any violation of law or regulation from your use of the Travelpigg Site
(b) Any breach, (actual or alleged) by you of any obligations, representations, warranties under this Terms of Use Agreement, including breaching of our Provacy Policy; and
(c) Any breach, (actual or alleged) infringement or misuse of the intellectual property rights of any third party by all User Content that you submit or a third party submits on your behalf or using your account.

Copyright & Intellectual Property

All copyrighted and copyrightable materials on the Travelpigg Site, including but not limited to the text, design, manuals, graphics, images, pictures, sound and other files, and the selection, compilation and arrangement thereof (collectively, "Materials") are ALL RIGHTS RESERVED Copyright (c) 2009-Travelpigg and/or its licensors.

Travelpigg allows you a limited license to only make personal use of the Site to access and review the Materials for your information purposes only. This license does not allow or include the right to:

(a)Use the Travelpigg Site or Materials for anything else other than the intended purpose, including but not limited to any profiteering, marketing, selling, or other commercial uses;
(b) Use of page capture technology to capture any portion of the Site, including any images found on the Site or any text and/or layout or design of any page or form contained on a page;
(c)Publish, display, or distribute to any third party any Materials that include the reproduction or hosting of the Materials on any computer network or broadcast or publications media;
(d)Derive uses of the Site or the Materials; or
(e) Any calculated collection or extraction of data through the use of any data mining, robots or similar data gathering or extraction methods.

Any unauthorized use of the Site will terminate the permission or license granted by Travelpigg to you under this Terms of Use Agreement and may violate applicable law, including but not limited to copyright laws, trademark laws (including trade dress), and communications regulations and statutes.

Member Disputes

You are solely responsible for your interactions with other Users. Provider reserves the right, but has no obligation, to monitor disputes between you and other Users.
